English abstract

A licence is a one-sided permission to use someone's else property, a legal tool transmitting the right to do something or to use a good that otherwise would not be possibile to use. There are closed and open licences. The latter (the most common are CC, GFDL, GPL, BSD) are not always suitable to be applied to data, as they are meant for other kinds of information, such as contents and software, and so on. The paper, focused on open licenses specific to data, starts referring to Panton Principles for open data in science. COnsiderations on intellectual property an open licences are interesting and relevant, within the framework of informative structures of databases and nano publications.

Una licenza è un permesso unilaterale di usare una proprietà di qualcun altro, uno strumento giuridico che trasmette un diritto di autorizzazione a fare qualcosa o a usare un bene che altrimenti, senza licenza, non sarebbe consentito per legge. Vi sono le licenze di tipo chiuso e licenze di tipo aperto. Le licenze aperte attualmente note (CC, GFDL, GPL, BSD), non sono sempre appropriate per i dati in quanto destinate ad altre tipologie di informazione (contenuto, software…). Il saggio focalizzato sulle licenze aperte specifiche per i dati si apre richiamando i principi Panton per i dati aperti nelle scienze. Se ci si proietta dalle dinamiche delle strutture informative dei database ad altri elementi modulari come le nanopubblicazioni, aggregate entro strutture rizomatiche reticolari, per entità e secondo schemi tipologici in dominii definiti, le riflessioni che ne emergono in termini di proprietà intellettuale e di licenze aperte sono quanto mai affascinanti.
