English abstract

The aim of this article is to analyse the State’s role in the evolution and development of the Spanish system of press face to the British model and the Euro-Mediterranean model of press. Whereas the Euro-Mediterranean model has a similar starting point: the Declaration of the Rights of Man and the Citizen of August 26, 1789, the British model is characterised by the inhibition of public powers, developed in concordance with the North American tradition begun with the First Amendment to the U.S. Constitution (December 15, 1791). For this reason, it is necessary to recognize the legislative measures that every country has followed to understand why the current situation needs to diagnose and prescribe global and local solutions.

El objetivo de este artículo es analizar el papel del Estado en la evolución y el desarrollo del sistema de prensa español frente al modelo británico y al modelo de prensa euromediterráneo. Mientras que el modelo euromediterráneo tiene un punto de partida similar: la Declaración de los Derechos del Hombre y el Ciudadano del 26 de agosto de 1789, el modelo británico se caracteriza por la inhibición de los poderes públicos, desarrollado en concordancia con la tradición norteamericana que comenzó con La Primera Enmienda a la Constitución de los Estados Unidos (15 de diciembre de 1791). Por esta razón, es necesario reconocer las medidas legislativas que cada país ha seguido para comprender por qué la situación actual necesita diagnosticar y prescribir soluciones globales y locales.
