English abstract

This paper presents a detailed analysis of the legal and ethical challenges surrounding the protection of Traditional Cultural Expressions (TCEs) and folklore within the Chinese copyright system, examined through the lens of IFLA's international guidelines and initiatives. The article explores the structural friction between traditional Western intellectual property frameworks—typically centered on individual authorship and limited-term protections—and the collective, transgenerational, and permanent nature of intangible cultural heritage. The author highlights the strategic role of libraries, archives, and memory institutions in documenting, preserving, and promoting these works. Ultimately, the paper advocates for the development of equitable and respectful access models that prevent unauthorized commercial exploitation and cultural appropriation while simultaneously safeguarding the public's right to knowledge and cultural diversity.

Italian abstract

Il presente contributo offre un'analisi dettagliata delle problematiche giuridiche ed etiche legate alla tutela delle espressioni culturali tradizionali (ECT) e del folklore nell'ordinamento cinese, esaminate alla luce delle riflessioni e delle linee guida promosse dall'IFLA. L'articolo approfondisce la complessa frizione tra le categorie classiche della proprietà intellettuale di matrice occidentale — tipicamente focalizzate sull'autore individuale e su tutele a tempo determinato — e la natura collettiva, transgenerazionale e permanente del patrimonio culturale immateriale. L'autrice evidenzia il ruolo strategico di biblioteche, archivi e istituzioni della memoria nella documentazione, conservazione e promozione di tali opere, sostenendo la necessità di modelli di accesso equi e rispettosi che prevengano lo sfruttamento commerciale non autorizzato e l'appropriazione indebita, salvaguardando al contempo il diritto collettivo alla conoscenza e alla diversità culturale.
