Abstract(s)
Following the Budapest Open Access Initiative (BOAI) of 2001, the Berlin Declaration on Open Access of 2003 gave the OA discussion a new impetus. The Declaration takes a very different approach from the Fair Use doctrine in the U.S., which is embodied in copyright law, whereas the Berlin Declaration postulates a voluntary system of Internet-based publication repositories together with incentives for depositors. Both approaches endeavour to make scholarly research and cultural heritage as broadly available as is possible, while freeing them of the status of trade-goods. This paper addresses the question of which of the two approaches is more promising in the long-term.
Nach der Budapester Open Access Initiative (BOAI) aus dem Jahr 2001 hat die Berliner Erklärung über Open Access vom Herbst 2003 der einschlägigen Diskussion neue Impulse gegeben. Die Erklärung unterscheidet sich ganz grundlegend in der Herangehensweise etwa von der der USA, die die sog. Fair-Use-Doktrin im Urheberrecht gesetzlich verankert haben, während die Berliner Erklärung von einem freiwilligen System mit Internet-basierten Publikationsdepots und Anreizen für Deponenten ausgeht. Ziel beider Ansätze ist es, sowohl wissenschaftliche Arbeitsergebnisse als auch allgemeines Kulturerbe einerseits möglichst breit zugänglich zu machen und sie andererseits weitgehend vom Status einer Handelsware zu befreien. Diese Untersuchung adressiert die Frage, welche der beiden Vorgehensweisen längerfristig tragfähiger erscheint.
