English abstract

The paper offers some reflections on the real opportunities, as well as those that have been “missed”, following the introduction of the new Open Access law in Italy. It examines the inevitable organisational consequences that the legislation imposes on research institutions, as well as its impact within the broader regulatory and legislative framework. Although it may be difficult to define the relevant provision as a “law”, it nevertheless represents a significant development that should be welcomed, both from a formal and an organisational perspective. The article also provides a brief comparison with the corresponding legislation enacted in Germany during the same weeks.

Lo scritto propone alcuni spunti di riflessione sulle opportunità reali e su quelle «mancate» a seguito della nuova legge sull’Open Access in Italia, sulle inevitabili conseguenze di riorganizzazione che il disposto normativo impone alle istituzioni che si occupano di ricerca e sul suo impatto entro il contesto normativo e regolamentare. Sebbene sia arduo definire «legge» il disposto normativo in questione, si tratta comunque di una novità piuttosto rilevante da accogliere con favore, sia dal punto di vista formale sia da quello organizzativo. Il presente articolo traccia un minimo confronto con l’analoga legge varata in Germania nelle stesse settimane.
