English abstract

This article examines the implications of the January 14, 2014 ruling by the Washington D.C. Circuit Court of Appeals, which favored telecom giant Verizon against the Federal Communications Commission (FCC). The decision struck down key provisions of the 2010 Open Internet Order, ruling that the FCC exceeded its regulatory authority over broadband providers. The legal issue stems back to 2002, when internet service providers were classified as "information services" rather than "telecommunication companies", thereby undermining the commission's statutory oversight. The author outlines the economic and democratic threats posed by this verdict, warning against the end of net neutrality, the potential creation of paid fast lanes, and the shift of the open Web toward a fragmented, monetized pay-TV distribution model.

L'articolo analizza le conseguenze della sentenza emessa il 14 gennaio 2014 dalla Corte d'Appello di Washington, che ha accolto il ricorso dell'Internet provider Verizon contro la Federal Communications Commission (FCC) statunitense. I giudici hanno stabilito che la FCC ha ecceduto le proprie competenze, invalidando i punti chiave delle Open Internet Order del 2010 che imponevano agli operatori di trattare tutto il traffico dati in modo equo e non discriminatorio. L'origine del problema risale al 2002, quando le internet companies vennero classificate come "information services" anziché "telecommunication companies", limitando la potestà regolatoria dell'autorità. Il testo evidenzia i rischi di questo vuoto normativo: la fine della Rete come piattaforma universale e neutrale, la potenziale frammentazione dei contenuti in pacchetti commerciali ("pay tv model") e la creazione di corsie preferenziali a pagamento che minacciano l'innovazione e il libero accesso.
