English abstract

Copyright is a central issue for scholarly communication. This is because of its nature. Copyright penetrates the whole scientific knowledge cycle. It can, therefore, directly or indirectly hinder the knowledge creation, recording, organization, publication, access, use, and re-creation. It also gives too much value even to the authors’ little originality. It gives authors exclusive moral and economic rights of their scientific works that actually are developed from and contain others’ works. In addition, copyright has a double-edged impact on scientific information creators and users as they are often the same persons. This paper elaborates the negative impacts of copyright on scholarly communication, and offers four scenarios for a more effective copyright management.

Indonesian abstract

Hak cipta memainkan peranan penting dalam komunikasi ilmiah. Hal ini adalah karena karakteristik dari hak cipta tersebut. Hak cipta bekerja di setiap tahap siklus pengetahuan. Hak cipta, langsumg maupun tidak langsung, mempengaruhi penciptaan pengetahuan, perekaman dan pengorganisasian, publikasi, akses, penggunaan, dan penciptaan kembali pengetahuan. Hak cipta juga terlalu memberikan penghargaan pada penulis ilmiah, yang kadar keorisinilan karyanya, umumnya hanya sekian persen (bukankah suatu karya ilmiah dibangun di atas penemuan terdahulu dan karenanya mengandung karya orang lain juga). Di samping itu, hak cipta juga memberikan dampak ’pedang bermata dua’ pada penulis dan pengguna karya ilmiah yang orangnya seringkali sama. Artikel ini menguraikan dampak negatif hak cipta pada komunikasi ilmiah, dan mengusulkan empat skenario untuk pengelolaan hak cipta yang lebih efektif.
