English abstract

The article examines the role of library lending as one of the most important services guaranteeing information access. Also, it highlights the importance of intellectual property laws in managing library services. The public lending right is analysed, within the context of the right to distribution, and its characteristics and legal regulation are studied. Finally, public lending is addressed as a service and as an author right, in connection with the new information services now available in the digital world.

El trabajo destaca el papel del préstamo bibliotecario como uno de los servicios que garantiza el acceso a la información. Asimismo, se pone de relieve la importancia de la propiedad intelectual en la gestión de los servicios bibliotecarios. Se estudia el préstamo bibliotecario como derecho de autor, encuadrado dentro del derecho de distribución, y se analiza su naturaleza y regulación legal. Por último, se aborda el préstamo como servicio y como derecho del autor en relación con los nuevos servicios de información disponibles en el entorno digital.
