English abstract

Latin America and the Caribbean is going through a path of lights and shadows. The Marrakesh Treaty began as an oasis in the desert, a legal instrument that constructs itself as a tool to exercise rights where you can quench your thirst (for reading). But there are many problems of interpreting the Marrakesh Treaty in binding terms with the Convention on the Rights of People with Disabilities and the interpretation of disability as a social construction to understand the need to reduce the access gaps transiting by people with disabilities who experience barriers to access to reading. Thus, this oasis has become a mirage.

América Latina y el Caribe atraviesa un camino de luces y sombras. El Tratado de Marrakech comenzó como un oasis en el desierto, un instrumento jurídico que se construye a sí mismo como una herramienta para ejercer derechos donde poder saciar la sed de lectura. Pero hay muchos problemas de interpretación del Tratado de Marrakech en términos vinculantes con la Convención sobre los Derechos de las Personas con Discapacidad y la interpretación de la discapacidad como una construcción social para comprender la necesidad de disminuir las brechas de acceso que experimentan las personas con discapacidades que transitan barreras de acceso a la lectura. Así, este oasis se ha convertido en espejismo.
