English abstract
The aim of the article is to study the current state of regulatory and legal governing the open science issues in Ukraine.The research methods ground on a set of basic scientific methods, including generalisation, systematisation and prognostication on the coverage of the regulatory and legal governing open science issues, analytical monitoring of the legislative basis and publications on the topic of the study. The scientific novelty. An analysis of the regulatory and legal governing the open science issues in Ukraine is carried out. The main list of regulatory documents governing the open science is highlighted. Tendencies in the development of the legislative framework are identified; problematic issues that need to be resolved at the state level are outlined.Main conclusions. The analysis of the regulatory and legal framework reveals its focus on advancing open science and supporting digital innovations in order to enhance the accessibility and exchange of scientific knowledge in Ukraine. Among the key priorities identified are enhancing existing blocks and creating new components of the national infrastructure to support scientific communication; developing digital infrastructures for science and innovations; facilitating integration into the European Open Science Cloud and Single European Research Ecosystem; joining the EOSC memorandum; strengthening state support for the participation of Ukrainian research institutions and scientists in national and European digital infrastructures. At the same time, despite notable progress in advancing legal mechanisms, several barriers continue to hinder the effective implementation of open scientific communication. The adoption of key legislative acts and strategic documents has established a legal foundation for expanding access to scientific information, integrating Ukraine into international open science initiatives and supporting the development of necessary infrastructure. A major key driver in this process is the National Plan for Open Science Implementation, adopted in October 2022. Still, the practical application of these measures continues to face numerous challenges that call for further refinement and systemic solutions

Мета статті – визначити стан нормативно-правового врегулювання проблем відкри-тої науки в Україні. Методи дослідження базуються на сукупності загальнонаукових методів узагальнен-ня, систематизації, прогнозування щодо висвітлення нормативно-правового врегулюван-ня питань відкритої науки, аналітичного моніторингу законодавчої бази та публікацій із теми дослідження. Наукова новизна. Здійснено аналіз нормативно-правового регулювання відкритої науки в Україні. Висвітлено основний перелік нормативних документів, що регулюють відкриту науку. Визначено тенденції розвитку законодавчої бази та окреслено проблемні питання, що потребують вирішення на державному рівні. Основні висновки. Аналіз нормативно-правової бази засвідчує її спрямованість на розвиток відкритої науки і підтримку цифрових інновацій для покращення доступності та обміну науковими знаннями в Україні. Серед ключових завдань визначено вдосконалення існуючої і створення нових елементів національної інфраструктури підтримки на-укової комунікації, розвиток цифрових інфраструктур для науки та інновацій, сприяння інтеграції до Європейської хмари відкритої науки та Єдиного цифрового простору Європи, приєднання до меморандуму EOSC, а також удосконалення державної підтримки участі українських наукових центрів і дослідників у національних та європейських цифрових інфраструктурах. Водночас, попри значний прогрес у розвитку правових механізмів, низка бар’єрів досі обмежує ефективне впровадження відкритої наукової комунікації. Із прийняттям ключових законодавчих актів та стратегічних документів було закладено правову основу для забезпечення доступності наукової інформації, інтеграції України у міжнародні ініціативи відкритої науки та розвитку відповідної інфраструктури. Ключовим драйвером є прийнятий у жовтні 2022 року Національний план щодо впровадження відкритої науки. Однак на практиці імплементація цих норм супроводжується численними викликами, що потребують подальшого доопрацювання та системного вирішення.
