English abstract

With Law no. 132 of 23 September 2025, published in the Official Journal on 25 September and in force since 10 October[1], Italy has equipped itself with the first national legislation entirely dedicated to artificial intelligence (AI). The measure follows in the footsteps of the European AI Act[2], approved in 2024, and represents an operational integration, with specific measures for the Italian context, from healthcare to public administration, from employment to cybersecurity. But beyond its symbolic value, what does this law concretely mean for libraries, archives and cultural institutions? The answer lies above all in the changes to copyright and the new rules for the use of protected content.

Con la Legge 23 settembre 2025 n. 132, pubblicata in Gazzetta Ufficiale il 25 settembre e in vigore dal 10 ottobre[1], l’Italia si è dotata della prima normativa nazionale interamente dedicata all’intelligenza artificiale (IA). Il provvedimento si colloca nel solco dell’AI Act europeo[2], approvato nel 2024, e ne rappresenta un’integrazione operativa, con misure specifiche per il contesto italiano, dalla sanità alla pubblica amministrazione, dal lavoro alla cybersicurezza. Ma al di là del valore simbolico, cosa significa concretamente questa legge per biblioteche, archivi e istituzioni culturali? La risposta sta soprattutto nelle modifiche al diritto d’autore e nelle nuove regole per l’uso dei contenuti protetti.
