English abstract

This paper critically analyzes the systemic contradictions of digital transformation in healthcare, focusing on the paradox of introducing artificial intelligence into medical practices while facing persistent local infrastructure, software, and cultural gaps (such as the inconsistent updating of Electronic Health Records). The author explores the legal and ethical implications of professional training, underscoring that the mandate for a conscious, responsible use of AI requires clinicians to critically validate algorithmic outputs rather than blindly delegating diagnostic decisions. Finally, the article highlights the strategic importance of Open Science and Open Access in ensuring that clinical decision-support systems are trained on certified, official scientific literature rather than opaque or proprietary data sources, thereby preserving medical information as a transparent and public good.

Italian abstract

Il contributo esamina criticamente le contraddizioni sistemiche del processo di digitalizzazione della sanità, soffermandosi sul paradosso che vede la spinta verso l'introduzione dell'intelligenza artificiale negli studi medici scontrarsi con persistenti limiti strutturali, culturali e informativi locali (come la mancata o parziale alimentazione del Fascicolo Sanitario Elettronico). L'autrice approfondisce le implicazioni legali ed etiche della formazione dei professionisti, evidenziando come l'obbligo di un uso consapevole ed eticamente responsabile dell'IA imponga al medico di non delegare ciecamente le scelte diagnostiche alla macchina. Il testo rimarca infine il ruolo cruciale dell'Open Access strategico per garantire che gli algoritmi di supporto clinico vengano addestrati su corpus certificati di letteratura scientifica ufficiale e non su fonti opache o proprietarie, preservando l'informazione medica come bene comune e accessibile.
