English abstract

This paper presents a critical analysis of the urgent need for a structural copyright reform aimed at restoring a fair balance between the economic privileges of rights holders and the fundamental rights of citizens to access culture and information. The article examines how the evolution of the digital marketplace, coupled with the pervasive use of restrictive licensing and digital rights management (DRM), has steadily eroded traditional exceptions and limitations designed for libraries, schools, and research institutions. Advocating for the primacy of "human-centered rules" within the legal framework of intellectual property, the author underscores the necessity of establishing non-overrideable statutory safeguards to protect the freedom to read, scholarly research, and digital preservation as essential public goods.

Italian abstract

Il contributo propone una riflessione critica sulla necessità di una riforma strutturale del diritto d'autore, orientata a ristabilire un corretto equilibrio tra le prerogative economiche dei titolari dei diritti e il diritto fondamentale dei cittadini all'accesso alla cultura e all'informazione. L'articolo esamina come l'evoluzione del mercato digitale e l'applicazione pervasiva di licenze contrattuali restrittive e misure tecnologiche di protezione abbiano progressivamente eroso le tradizionali eccezioni a favore di biblioteche, scuole e istituti di ricerca. Sostenendo la centralità delle "regole umane" nell'architettura giuridica della proprietà intellettuale, il testo evidenzia l'urgenza di introdurre tutele inderogabili che garantiscano la libertà di lettura, la ricerca scientifica e la conservazione della memoria digitale come beni comuni sottratti alle logiche di mercato.
