English abstract

This paper examines the complex legal dispute surrounding the copyright of Anne Frank's writings, analyzing the structural tension between territorial copyright laws and the global accessibility enabled by the internet. The analysis is updated with the landmark ruling of the Court of Justice of the European Union on July 9, 2026 (Case C-788/24), which defined the boundaries of digital publishers' liability regarding geographical restrictions (geoblocking). The author explores the implications of this ruling, which permits the online publication of works that have locally entered the public domain, provided that reasonable geoblocking measures are implemented. Furthermore, it exempts publishers from liability if users bypass these blocks using VPNs. Ultimately, the paper highlights the significance of this decision for scientific research, library digitization projects, and the preservation of shared historical memory within the European digital ecosystem.

Italian abstract

Il presente contributo esamina la complessa vicenda giuridica relativa ai diritti d'autore sulle opere di Anna Frank, analizzando la tensione strutturale tra il principio di territorialità del copyright e l'accessibilità globale garantita dalla rete internet. Il testo viene arricchito e attualizzato alla luce della storica sentenza della Corte di Giustizia dell'Unione Europea del 9 luglio 2026 (causa C-788/24), che ha definito i confini della responsabilità degli editori digitali nell'applicazione delle misure di blocco geografico (geoblocking). L'autrice approfondisce le implicazioni di questa pronuncia, che legittima la pubblicazione online di opere di pubblico dominio a livello locale qualora vengano adottate barriere geografiche adeguate, escludendo la responsabilità del pubblicatore in caso di elusione tramite VPN da parte degli utenti. Il saggio evidenzia la rilevanza di tale decisione per la tutela della ricerca scientifica, dei progetti di digitalizzazione delle biblioteche e della libera circolazione della memoria storica in Europa.
