English abstract

This paper provides a technical and comprehensive analysis of the legal disputes surrounding the expiration of copyright and the transition of Anne Frank's diaries into the public domain. The article examines the complex textual stratification of the work—distinguishing between the original autographed manuscripts and subsequent editions revised by Otto Frank and other editors—to illustrate how arguments regarding literary co-authorship and differing regulations on posthumous works have been leveraged to extend exclusive protection beyond the standard term of seventy years post-mortem. The author reflects on the ethical and scholarly implications of these prolonged protections, highlighting the stark contrast between the commercial interests of rightsholders and the public interest in ensuring free, unhindered access to one of the twentieth century's most significant historical testimonies.

Italian abstract

Il presente contributo propone un'analisi tecnica e approfondita delle controversie giuridiche inerenti alla scadenza dei diritti d'autore e all'ingresso nel pubblico dominio dei diari di Anna Frank. L'articolo esamina la complessa stratificazione testuale dell'opera — distinguendo tra i manoscritti autografi originari e le successive edizioni rielaborate da Otto Frank e da curatori editoriali — per illustrare come le tesi sulla co-paternità letteraria e le diverse normative sulle opere postume siano state utilizzate per estendere la durata della tutela esclusiva oltre il termine standard dei settant'anni dalla morte dell'autrice. L'autrice del saggio riflette sulle implicazioni etiche e scientifiche di tali tutele prolungate, evidenziando il forte contrasto tra gli interessi economici dei titolari dei diritti e l'esigenza sociale di garantire un accesso libero e incondizionato a una delle testimonianze storiche più rilevanti del Novecento.
