English abstract

This paper analyzes the landmark resolution of the decade-long legal battle between Google and the U.S. Authors Guild, which culminated in a Supreme Court ruling validating the legitimacy of the Google Books project. The article traces the key stages of the litigation, examining how the massive scanning and digitization of millions of printed books—solely for indexing purposes and displaying short text snippets—was legally recognized as a transformative "Fair Use." The author highlights the significant implications of this decision for the development of modern digital libraries, scholarly research tools, and the legal balance between creators' copyright protections and the public's right to information and discoverability within the digital ecosystem.

Il presente contributo esamina la storica conclusione della controversia legale tra Google e l'Authors Guild statunitense, culminata nella decisione della Corte Suprema che ha sancito la piena legittimità del progetto Google Books. L'articolo ricostruisce le tappe principali della vicenda giudiziaria durata oltre un decennio, analizzando come l'attività di scansione massiva di milioni di opere a stampa — finalizzata all'indicizzazione semantica e alla visualizzazione di brevi porzioni di testo (snippets) — sia stata riconosciuta come uso trasformativo coerente con la dottrina del Fair Use. L'autrice riflette sull'enorme impatto di questa sentenza per la nascita delle moderne biblioteche digitali, per il lavoro dei ricercatori scientifici e per il bilanciamento tra la tutela economica degli autori e il diritto collettivo all'accesso alle informazioni nell'ecosistema digitale.
