English abstract

This paper examines the impact of the new Italian legislation on Artificial Intelligence (Law no. 132/2025) and the European framework (EU AI Act) on copyright law and scholarly communication infrastructures. The article explores the intricate relationship between human creativity and algorithmically generated outputs, focusing on the legal protections governing model training. The author analyzes the critical challenges surrounding Text and Data Mining (TDM), highlighting the structural tensions between statutory exceptions for scientific research and the exercise of opt-out rights by commercial rightsholders. Ultimately, the essay reflects on the broader implications that these contractual and regulatory barriers impose on bibliographic discoverability and the core principles of Open Science within academic library ecosystems.

Il presente contributo analizza l'impatto della nuova legge italiana sull'intelligenza artificiale (Legge n. 132/2025) e del quadro regolatorio europeo (EU AI Act) sul diritto d'autore e sulle infrastrutture della comunicazione scientifica. L'articolo esamina la complessa relazione tra l'atto creativo umano e i contenuti generati da sistemi algoritmici, soffermandosi sulle tutele giuridiche applicabili al training dei modelli. L'autrice approfondisce i nodi critici legati alle attività di Text and Data Mining (TDM), evidenziando le forti tensioni tra le eccezioni legislative a favore della ricerca scientifica e l'esercizio del diritto di opt-out da parte dei titolari dei diritti economici. Il saggio riflette, infine, sulle ripercussioni che tali barriere contrattuali e regolatorie possono esercitare sulla discoverability dei dati bibliografici e sui principi della Scienza Aperta all'interno delle biblioteche accademiche.
