English abstract
This paper discusses the challenges outlined in the “Safeguard Access, Empower Europe” strategic action plan launched by the European program Knowledge Rights 21 (KR21), focusing on the critical need to release libraries from technological and contractual constraints in the digital environment. The article examines the paradox whereby, during the transition from analog to digital mediums, the fundamental mission of memory institutions is systematically undermined by Digital Rights Management (DRM, or "digital padlocks") and non-negotiable licensing agreements imposed by commercial publishers. The author analyzes the nine policy actions proposed by KR21 to reshape national and European regulatory frameworks, advocating for urgent copyright reforms that protect scholarly and cultural resources from being reduced to temporary, revocable subscription services, thereby reclaiming the permanent public role of libraries in the digital age.

Il presente contributo analizza le sfide descritte nel piano d'azione strategico “Safeguard Access, Empower Europe” promosso dal programma europeo Knowledge Rights 21 (KR21), focalizzandosi sulla necessità di liberare le biblioteche dai vincoli tecnologici e contrattuali nell'ambiente digitale. L'articolo esamina il paradosso per cui, nel passaggio dal supporto analogico a quello digitale, il ruolo delle istituzioni della memoria viene sistematicamente indebolito dall'applicazione di misure tecnologiche di protezione (DRM, o "lucchetti digitali") e da licenze di adesione non negoziabili imposte dai grandi editori commerciali. L'autrice approfondisce le nove azioni politiche proposte dalla guida di KR21 per ridefinire i quadri normativi nazionali ed europei, sostenendo l'urgenza di riforme del copyright che sottraggano la conoscenza alle logiche dell'abbonamento temporaneo e revocabile per riaffermare la missione pubblica e permanente delle biblioteche nell'era contemporanea.
