English abstract
This paper examines the impact of the Italian Law of October 10, 2025, no. 132 on the domestic library and archive landscape, framing it as the first national legislation entirely dedicated to artificial intelligence (AI) aimed at integrating the European principles of the AI Act. The analysis specifically focuses on the significant amendments introduced to the Italian copyright law (Law 633/1941), which clarify that works created with the aid of intelligent systems are protected only if they result from the intellectual and creative effort of a natural human author. Furthermore, the study explores the new exception for Text and Data Mining (TDM) under the newly introduced Article 70-septies, which grants research organizations and non-profit cultural heritage institutions the right to extract text and data for scientific or preservation purposes, while highlighting the subsequent need for libraries to implement strict internal policies regarding data traceability and lawful access. Finally, the author outlines the strategic role of cultural institutions as hubs for digital literacy and public facilitation, documenting training initiatives funded by the PNRR in collaboration with the AIB, and illustrating advanced practical applications of AI in heritage management, such as automated semantic indexing and large-scale bibliographic record de-duplication.

Il contributo esamina l'impatto della Legge 10 ottobre 2025, n. 132 sullo scenario bibliotecario e archivistico italiano, inquadrandola come il primo provvedimento nazionale interamente dedicato all'intelligenza artificiale (IA) volto a integrare i principi europei dell'AI Act. L'analisi si concentra in particolare sulle significative modifiche introdotte alla legge sul diritto d'autore (Legge 633/1941), le quali specificano che le opere realizzate con il supporto di sistemi intelligenti sono tutelate solo in presenza di un effettivo e dimostrabile apporto creativo da parte di un autore umano persona fisica. Viene inoltre approfondita la nuova eccezione sul Text and Data Mining (TDM), disciplinata dall'introduzione dell'articolo 70-septies, che riserva agli organismi di ricerca e agli istituti di tutela del patrimonio senza scopo di lucro la possibilità di estrarre testi e dati a fini scientifici o di conservazione, delineando parallelamente la necessità per le biblioteche di adottare rigorose policy interne di tracciabilità e legittimità degli accessi. L'autrice delinea infine il ruolo strategico delle istituzioni culturali come hub di alfabetizzazione e facilitazione digitale per la cittadinanza, documentando i percorsi formativi sostenuti dal PNRR in collaborazione con l'AIB e illustrando applicazioni pratiche avanzate dell'IA nella gestione dei patrimoni, quali i processi automatizzati di indicizzazione semantica e la deduplicazione bibliografica su scala globale.
