English abstract
This is a long book review on the translation and presentation of some German Enlightenment writings on intellectual property. It scrutinizes, in particular, Kant's position on the "Nachdruck" question. Against the book editor's opinion, it tries to show the link between Kant and the Roman law tradition (according to which only "res quae tangi possunt" can be legally owned) and his idea of a book as a speech - an action, not a thing. Publishing is like talking in the name of another: for this reason, it requires a mandate from the author. But, if books are speeches, not things, Kant does not endorse a theory of intellectual property and may be read as a different, interesting term of comparison.
